Charging documents were released Tuesday that accuse a 12 year-old Sunbury-area boy of murdering his mother’s fiance.
Law enforcement officials allege Nicholas J. Boleware “knowingly and with purpose” shot Jeffrey Reece, 38, behind the left ear with a .22-caliber revolver, killing him.
Reece, 38, died after Boleware shot him shortly after midnight on Saturday morning following a heated argument, prosecutors allege. The shooting took place in his home at 12010 Stockwell Road in Trenton Township, Boleware and his mother, Wendy C. Boleware, also lived.
Boleware cannot be charged as an adult under Ohio law since he less than 14 years old. The maximum sentence for any crime in the juvenile court system is detention until the age of 21.
The boy told a 911 dispatcher that he shot Reece, who was threatening him and his mother with a shotgun, according to a recording of the call.
He shot Reece a second time while he was lying on the ground to make sure he was dead, Wendy Boleware told the dispatcher later in the call.
Nicholas Boleware remains in a juvenile detention facility in Marysville. An arraignment, a court hearing where he will be formally presented with charges, will be scheduled within the next several days, an assistant to Juvenile Court Judge Kenneth J. Spicer said.
