If you are a property owner in the City of Delaware, you are responsible for removing snow and ice from your sidewalk.


“Keeping your sidewalks free of snow and ice is not just the neighborly thing to do, but it’s also the law,” community affairs coordinator Lee Yoakum told The Gazette. “It’s the law because it protects the safety of every individual in Delaware.”


City ordinance 521.06 prohibits accumulation “to the annoyance of the public.” If one is annoyed at the amount of snow and/or ice on a sidewalk, they can call the city’s Code Enforcement department at 740-203-1660. You will need an exact address and, if applicable, the business name.


“It is complaint-driven, and when we get a complaint, we’ll respond and follow up with the appropriate property owner,” Yoakum said. “Usually that’s all it takes, is a phone call.”


If you are physically unable to remove the snow from your walk, “we would take that information into account, follow up with them, and try to work with the individual,” Yoakum said. The city’s website said that under the Americans with Disabilities Act, “accessibility to sidewalks for disabled individuals is required.”


The ordinance has been on the books for decades, he said.


“It’s important that snow and accumulated ice be removed so people are able to walk and ride safely, without having to travel in the street and interact with vehicular traffic,” Yoakum said. “An area of particular concern is the school zones, going to and from school in the morning and afternoon. It’s especially important to keep those areas clear and free of ice and snow.”


In addition, the snow needs to be clear around fire hydrants, so the Fire Department can find them if needed.


The snow can’t be deposited on another public sidewalk or street, because it creates a hazard and safety issue for vehicles.


Prior to last night’s snowfall, Yoakum said the city pre-treated roads with brine and beet juice.


If you haven’t already done so, please remove your vehicles from City streets to help with the snow plowing. The priority of plowing is state highways and primary roadways first, 12 hours after the snow ends; collector roads, school zones and the airport second, 24 hours after the snow ends; subdivision and residential roads on a rotating basis third, 48 hours after the snow ends.
